One its proving it, two its costly and three is it worth it.
Bounced cheque is common one, I've heard the PO might stop taking cheques and in future only allow debit/credit cards, or cash.

Just keep all the evidence you have, you did right getting the DVLA involved and hopefully commomn sense will reign. Afetr all if you can't rust the disk in the windscreen what is the point in issuing them? the police use the PNC anyway which tells them whether or not you're insured and taxed.
Unfortunately I think you'll be paying the back tax on the last 2 months, they won't let you have it free. I'd double check that MOT too 8-[
It does prove what a useless system they have, any car that's SORNed looses the status when it's sold and has to be taxed or SORNed by the new owner, so if there was an issue with the tax why didn't they contact you when you registered it?

Personally I would look up and visit the local DVLA office;talk to them there and show them all the evidence; hopefully they will be very interested.
Also you are talking of a sum of money that is well within the limits for the small claims court; if you can prove that the advert was false and that the disk was false then its not expensive through small claims and if you win (which you should) then you get the fees back from the other party anyway.
I would still visit DVLA as it coule be a genuine mistake still.

No, you're only liable from the date that you become the registered keeper, the day you paid for it. ;)
