I read somewhere on a forum ( will find the white paper again when I remember where ) that using a CB whilst driving is not illegal under the "use of mobile phones whilst driving" law.
There's a loophole that allows the use of CB or taxi radios because they are not "Duplex" i.e. On a phone you can transmit and receive at the same time, on CB & two way radios you cannot... so they are not covered by the new laws..
HOWEVER, I reckon the alternative charge would be driving without due care and attention if you argued with the boys in blue, so I wouldn't recommend daring them to pull you... Just make sure you get charged with the correct offence

Ah yes, taxis, I supposes they would argue they need to be able to use the radio whilst driving, even though they don't.

Theres no way the average copper can tell a CD set from a PMR set, Tetra Set, Amatuer set or whatever. Theres also the fact that any move to outlaw using them on the move will catch out all of the emergency services too.
Looking at my car or Rabbit can you tell which aerial does what from the 4 that are mornally on there?
