MOT Question / appeal

Uncles Jeep has failed on a badly worn UJ in the front axle, tester said "it was dangerous to drive it is so worn".
Just taken a look and it is fine, Jeep has done 66k miles, and has no visable wear on the UJ, zero play and no noise on full lock (will have a good look tomorrow in daylight). Said garage has a bit of a reputation shall we say, He has always been honest with me on the MOT's but this one isn't right.
So what do i do, jeep needs MOT before monday. Do I appeal or just go elsewhere and get another test done then appeal afterwards??

Can you see the uj or is it incased inside the front axle casing

are you sure you are looking at the correct joint?
get him to show you the unsafe play.
then if hes takin the.... get a big bar and swing it about a lot.

Does he not mean the prop shaft UJ, rather than the CV joint?

I have checked the UJ he saaid to my uncle it was, thing is they talked him into them fixing it for him next week and kept the fail sheet. I am off there tomorrow to get the sheet and have words.
