Are rear seat belts needed?

My car (fiat cinquecento) is in for the mot tomorrow and i have been falling out with my old man about whether it will pass or not due to the fact i have taken out the rear seat and seat belts. I was under the impression that if they are there they need to be in good condition but if the rear seats are out then they arent needed.

The law states that if seats are fitted they need to have seatbelts, but if there are no seats then no seatbelts are required. I had a bother with me first 109 a few years ago where the passenger side rear seatbelt didnt work (it was a station wagon). I took out the offending seat and it passed the mot.

I would also agree that if no seats AND seat belts are in place its ok

No you dont need Seat belts as the seats are not fitted
