MOT Question

Have a car I'm sorting out for a friend. Having sorted all the niggles I'm left with a rust patch to sort.

Thing is, we cantr agree on it being an MOT faulre or not. Its penetrative rust (2 holes) on the wing where it meets the sill, the sill itself is sound, its just the wing inside the doorframe thats shot. It shouldnt be hard to patch but does it even need it? Dont beleive its a structural comonenet as the sill under it meets the subframe further back and a huge box section that contains the suspenstion mount etc. All this does is fill the gap between sill and structural member.

Audi 80 2.0E Auto 1991. Rea Subframe and indept suspention rather than the newer beam axle
