turns out that the police stopped the same car the day b4 but didnt impound it even though it had no tax or insurance

the driver was 15 and drunk and asked his m8 to show him how to reverse and he floored it and hit the neibours car and  a wall and the neibour saw him and grabbed him and then waited for the police to come and they took him away
then the next day(xmas day) there mum ended up in hospital via an ambalance  so they didn't have a good xmas

Yes, unfortunately by the road traffic act, if the car was stolen or otherwise belonged to another party who insures it then that party pays (via an insurance claim obvioulsy).  This is to ensure that 3rd party damage is covered by insurance where possible.

What gets tricky is when the car belongs to someone who doesn't insure it, whether or not it was stolen, you then have to persue the driver IIRC.

If the car belonged to the driver (or a passenger in it in this case) I think the car should be forfeit as compensation, but it does't work like that does it, the law protects the criminal :roll:
