harrassment advice needed please

I am having a really bad time at work recently mainly due to my permanent loader being the laziest person ever and anything to get out of doing 3 minutes work he will, yet he will do anything he can to get out of it, like take 5 minutes to roll a fag.
He is one of these young people who seems to think it is ok to spit everywhere as well. I cant prove anything as I didnt see him do it but I have 3 gobs of spit on my car now. It was very fresh when I got in my car as it was still dribblng down the doors and windows.
I have taken photos of it all and 2 swabs on cotton buds. Should I report the incident to the police, or would the police not care or not enough evidence etc? Surely they could prove if it is him or not by the gob on the car?
If anyone knows of ANY job in the Banbury area please let me know. I start with an agency driving class 1 lorries on Monday for Mondays only (I work 4 days a week where I currently am) but I cant take this any longer. I shouldnt want to come home and curl up in a ball and cry each night. My boss says he is working on it to sort the problem out with my loader but he has been working on it for a few months now. I will do near enough any job now, even if it means driving at weekends to get experience up to get a full time job somewhere, but in the mean time stack shelves in tesco for example. I cant remember the last time I was this unhappy in life.

Dude I sympathise totally, what is it with drivers and their loaders? I had a guy back his forklift into my daf and claimed he saw me roll into his forklift. Needless to say this was a while ago now and have since walked.
The only advice I can really offer you is to speak to Citizens Advice and see where you stand legally with collecting evidence etc, Meanwhile I will speak to my boss at work and see if I can get something from an employer point of view.
For Gods Sake "Don't Worry" I know it's very hard to do and now is not the time to walk from a job but your mental health and happiness is worth far more than any job. I have been in the little ball crying situation before so I know where you are coming from.
Keep your chin up and keep a clear head. I will see what I can do for you advice wise from work.

Muddy get your self down to the Doctors as soon as mate.
Tell them how you feel, i went through something similar about 3 yrs ago, and went to see Docs who helped me out of it.
It might not just be your loader where the problem is!!!

hi James, sorry to here of your situation, i have had similar experience myself, do you have a human resources department within your company? if so report it as bullying may sound that your soft but you will get the quickest responce from the HR due to leagal terms now in place. Don't expect instant results as they may ask for the situation to be monitored and the person in question will more than like stop there actions before any disciplinary take place, look on this as job done and not he's got away with it.
If you have reported it to your boss find out what progress he has made, what actions has taken if any, has he spoken with the individual or not. if it has taken some time and no reasonable progress has been made take legal advise from c/advise as your company has responsibility for your welfare if they are neglecting these then you have a strong case to go to tribunal and will most probably win as unlike normal court prove beyond reasonable doubt tribunal you only have to show probability.
try and get a number for a employment law solicitor as well they will be on your side as that is there job a voice for the small person. hope helps you in some way.
