As some may remember i had an accident in the zuki last october.
(and for those that dont.. heres a summary: Guy in an Alfa decided to try and park under my rear wheel. After lots of back and forwards he decides to say its my fault.. i swearved and hit him.. now damage was to my passanger side and his driver side, with me swerving from left to right..  confussed yet?:roll: i suffered damage to my right shoulder and down my back, so ive been unable to drive the car for over a year and some aspectd of my job ive had to find new and exciting ways of acheiving without the prospect of either loosing my job or being demoted due to not fullfilling my duties.
this is now on its way to court for the aspect of liability.)

heres where everyone who knows the story can rejoin...

Today i come home to a letter from the solicitors with the thinking that it was court dates/yet more paperwork to sign.
well to my suprise it was an offer that the third party had put in for £2,250.00. Solictors think this is there submission of guilt as it were but are not 100% sure. They also think that personal injury alone provided i make a full recovery after the 20 months (so far its been 13, i got told another 9 months recently at my reassesment). Settlement should be in the region of £2,700.00 - £2,950.00 with them initially aming for the higher figure.

with other expensise and going on the higher figure this gives me an overall settlement for £4,450.00

ive gotta let them know how id like to procded to which i currently have an idea. however whats everyones thoughts on this.. (this is there second offer now, first was £1,700)

Take it to court.... my solicitors advised i accept an out of court settlement of £2,500 (which i foolishly did). earlier this year a work colleague got £18k for same injury

Do some homework and check records of cases with similar injuries that have gone to court.

I am in a similar situation, got rear ended last september - had an independant medical advisor examine me - he said i needed 20 courses of physio - I  had 6 and the physio stopped them as I was not making any progress ( had 50% mobility of my spine before physio and 51% after!!!!!!!) recently had another letter from solicitors advising that ANOTHER medical examination is due - and that this will be for a settlement claim ( hopefully!!) I am still unable to either stand or sit for more than 10 mins without being in pain - and cannot drive a 'normal' car due to the lower driving position and pain in getting in and out!So heres hoping that the claim will cover a nice 'High' car ;)
What really narks me , is the guy that rear ended me only lives around the corner and he had his car repaired and back on the road in less than a fortnight - it took them longer than that to come and inspect mine and tell me it was a write off :evil:  :evil:

If your solicitor is confident in proving your case DO NOT accept this offfer, I worked for a large insurance company in there Personal Injury dept, we tried to settle at 10% of the actual value of the claim should it go to court and be proved in your favour.

Say no, put your reasons forwards and see what happens, the offer will only increase, you should expect another offer and then it should go to court. Best of luck with it. Just think, you have been injured through no fault of your own, you need to be compensated for it!

Stick to your gun's mate, as Stuntman said put forward your point as to why you feel you cant accept the offer, And go to court if need be. I am just in the early days of a massive personal injury claim, after having my legs crushed at work, and nearly dying as a result. I have about 2 years now until I will be able to walk. the insurance had the cheek to try and get me to sign papers while I was still high on morphine in hospital basically accepting 8k in full settlement. I didn't have a solicitor until the next day I never signed it!!! and now I am looking at 750k plus according to the solicitor. The insurance companies are so devious and immoral at times. just think about all the money you pay out during your life on everything, now is your chance to grab some back. just makes you sick though having to argue your point when it is just what you deserve!! :x  hope you get sorted, and get better from your injuries.
