The whole idea of many of these sites was to give unsigned bands an opportunity to have the world hear their music, have it passed about across the world, and hopefully someone with contacts would like it, then sign them etc. etc. etc.
The whole P2P thing works so people can both access others files, and have their own music/video files accessed, thus giving a worldwide file sharing network.

So far all legal, as its all 'public domain' files (ie ones which are legal for sharing/swapping)

The problem arises when some user adds his own legally bought cd/dvd to his music files. Now thats OK, cos he owns the cd, royalties have been paid etc, but suddenly it appears on his shared music file, so other users now have access to it. This is the point where it becomes illegal.

So really, the whole file sharing thing isnt  neccesarily illegal, its just getting used for non legal stuff by the majority.
