so in theory, me moving dads car on our drive, or anyone else moving partners car etc etc on their own driveway without insurance *could* be prosecuted?

No, the public need permission to be there. Such as a campsite or a pay n play or a right of way or a carpark
Eeyore:
Bobs right, if the public have access then the rules of road apply.
Billing last year really tightened up on night time shenanigans because of this, hence no late night site drives with a bottle in the hand and no mini-motos tearing around the place. Made the site a lot safer.
For driving off the public highway without landowners permission, that isn't tresspass (civil offence), its breach of the Road Traffic Act (can't remember which bit) and constitutes a criminal offence.
So either way, yon bobby just wasn't prepared to do his job.
[old man mode]We don't need more rules and laws. We need folk to enforce the ample we already have <mutter mutter> [/old man mode]
I'm very thankfull that in this case, no one got hurt.

Obviously plod didn't fancy tackling a drunken scotsman
If I'd have been the warden I would have been demanding police attend in no uncertain terms as there was clearly a danger to the public and pursuing a complaint as they did not.
Good thing it wasn't far worse though.
